How Rules Are Made
The procedure for establishing Administrative Rules is set by Hawaiʻi Revised Statutes Chapter 91 and involves an extensive public review and hearing process.
The Procedure
1. Drafting and Initial Approval
- A proposed rule (or amendment) is drafted by the department.
- It is then approved by the Board of Land and Natural Resources (BLNR) for public meetings/hearings.
- It is reviewed by the Department of the Attorney General (AG).
2. Public Review
- The draft is taken out to public meetings and/or hearings.
- The public can give formal testimony on the draft rule.
3. Finalization and Enactment
- The rule is revised, if necessary, based on public input.
- It is then submitted to the Board of Land and Natural Resources (BLNR) for final approval.
- It is reviewed again by the AG.
- After signing by the Governor and filing with the Lieutenant Governor, the rule has the effect of law.

- Official Copies: Official copies of the rules may be obtained from the Division of Aquatic Resources and the Division of Conservation and Resources Enforcement offices statewide. Copies are also available for viewing in State public libraries.
